Customer Sues Houston Salon for Negligence Leading to Severe Pedicure Injury

A shocking case of alleged negligence and gross negligence has been brought to light as a Harris County resident seeks justice for injuries sustained during a pedicure. On July 17, 2024, Lashonder Demery filed a complaint in the District Court of Harris County against Ho Nhan Van and his business, Gelina Hair & Nail.

According to the lawsuit, Demery visited Gelina Hair & Nail on July 23, 2022, for a routine pedicure. The complaint details that the pedicurist, either Van himself or an agent of the defendants, failed to follow basic hygiene protocols. "The pedicurist did not wash or sanitize his hands or the service area," reads the petition. Furthermore, it alleges that unsterilized tools were used during the procedure, resulting in severe injury to Demery's toe.

The plaintiff recounts that despite her immediate complaints of pain and discomfort, the pedicurist continued with such force that it led to significant bleeding and infection. The petition states: "As a direct result, Plaintiff's toe began to bleed, swell, and later become infected." This injury has reportedly caused ongoing pain and impairment.

Demery accuses Van and his business of multiple breaches of duty of care including failure to use sterilized instruments and maintain a clean environment. The lawsuit also claims gross negligence due to "an extreme degree of risk" posed by their actions. It further asserts that these actions were done with "conscious indifference" to her safety.

The plaintiff is seeking compensation for past and future medical expenses, physical pain, mental anguish, impairment, disfigurement, loss of enjoyment of life, lost wages, pecuniary loss, and loss of earning capacity. Additionally, she seeks pre-judgment and post-judgment interest along with court costs.

Representing Demery is attorney Belashia S. Wallace from The Wallace Law Firm PLLC. The case is presided over by Judge Egypt Young under Case ID 2024-44823 in the 165th District Court.
