Construction Worker Sues Employers Over Severe Workplace Injury

A Houston construction worker has filed a lawsuit against his employers, alleging severe negligence that led to a significant workplace injury. Wilder Jalal Saucedo filed the complaint in Harris County District Court on July 23, 2024, against Advanced Construction, Advanced Construction Clean Up, JFO Solutions LLC, and Mauro Arce Estrada.

The case revolves around an incident that occurred on August 4, 2022. Saucedo was working on a three-story home at 6715 Haight Street in Houston when he fell from the second floor to the ground while attempting to grab plywood from a coworker. According to the complaint, Saucedo was not wearing a safety belt at the time of the fall. The plaintiff asserts that this accident resulted in severe bodily injuries and damages.

Saucedo's lawsuit alleges multiple instances of negligence by his employers. He claims they failed to provide a safe workplace by improperly transporting materials without proper safety equipment and using substandard procedures and equipment. "Defendants’ employees also failed to safely transport the items by failing to follow proper procedures and using substandard equipment," states the petition. Furthermore, Saucedo accuses his employers of inadequate training and supervision of their staff and insufficient staffing and safety equipment provision.

Under Texas law, employers have a non-delegable duty to ensure a safe workplace for their employees. The plaintiff cites Texas Labor Code §411.103, which mandates employers to provide reasonably safe work conditions and necessary safeguards for their employees' health and safety. The lawsuit argues that Advanced Construction and its co-defendants failed in these duties, leading directly to Saucedo's injuries.

The plaintiff is seeking various forms of relief from the court. These include compensation for past and future physical pain and suffering, loss of earnings capacity, medical expenses incurred due to his injuries, physical impairment, mental anguish, physical disfigurement, taxable court costs, as well as pre- and post-judgment interest at the highest legal rate.

Representing Wilder Jalal Saucedo are attorneys Taylor R. Gamboa and Brian E. White from Attorney Brian White & Associates P.C., based in Houston. The case has been assigned Case ID 2024-46202 in the 129th Judicial District Court of Harris County with Judge Patricia Jones presiding.
