A Houston resident has filed a lawsuit against her apartment complex, alleging negligence after suffering personal injuries due to a defective stair step. Daisy Marcos-Mendez lodged the complaint in Harris County District Court on August 9, 2024, targeting Ashford Stoneridge Apartments LP and HK Capital, LLC.
According to the filing, Marcos-Mendez was injured on July 22, 2024, while residing at Ashford Casa Bella Apartments located at 10615 Beechnut Street in Houston. The plaintiff claims she fell when a stair step broke in half under her weight. She asserts that she had no prior knowledge of the hazardous condition and could not have reasonably discovered it herself. The complaint states that the defendants either created the dangerous condition or failed to rectify it and warn residents about it, thereby constituting negligence.
The lawsuit details several allegations against the defendants, including failure to maintain the premises in a safe condition, failure to inspect for potential hazards, failure to correct known dangers, and failure to inform tenants of such risks. "Defendant either created the condition and/or failed to correct the condition or warn Plaintiff about the dangerous condition," reads part of the complaint. Marcos-Mendez argues that these failures directly led to her injuries.
Marcos-Mendez is seeking monetary relief of $250,000 or less for damages excluding penalties, costs, expenses, pre-judgment interest, and attorney’s fees. She reserves the right to amend this amount if necessary. The damages sought include past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement as well as lost wages and loss of earning capacity.
