Plaintiff Alleges Local Convenience Store Negligence Over Slip-and-Fall Incident

A recent court filing reveals a gripping legal battle over an alleged slip-and-fall incident at a local convenience store. On August 8, 2024, Jaquaries Johnson filed a complaint in the District Court of Harris County, Texas against Hamilton C-Store LLC, alleging negligence and seeking significant monetary relief.

The lawsuit stems from an incident that occurred on November 21, 2023, when Johnson was visiting the Hamilton C-Store located at 1818 Hamilton Street in Houston. According to the complaint, Johnson slipped and fell due to a slick substance on the floor. The plaintiff asserts that there were no warning signs or any other indications of caution near the area where the fall occurred. Johnson claims he was unaware of the dangerous condition and could not have reasonably been expected to discover it.

In his petition, Johnson alleges that Hamilton C-Store LLC knew or should have known about the hazardous condition but failed to either correct it or warn him about it. The complaint states: "Defendant either created the condition and/or failed to correct the condition or to warn Plaintiff about the dangerous condition, which constituted negligence." This negligence is cited as the direct cause of Johnson's injuries.

Johnson further argues that as an invitee on the premises, he was owed a duty of care by Hamilton C-Store LLC. The defendant is accused of failing to maintain safe conditions on their property, neglecting to inspect for hazards, and not taking reasonable measures to safeguard visitors. Specifically, Johnson's complaint lists several negligent actions including failure to maintain safe floors and walkways, failure to inspect for dangerous conditions, failure to correct such conditions, and failure to inform visitors like himself about these dangers.

The damages sought by Johnson are substantial. He is requesting compensation for past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, as well as lost wages and loss of earning capacity. The total monetary relief sought ranges between $250,000 and $1 million.

Amador from Amador Law Firm based in Brownsville, Texas, Johnson seeks judgment against Hamilton C-Store LLC for an amount within the jurisdictional limits of the court along with pre-judgment and post-judgment interest and all associated court costs.

The case has been assigned Case ID 2024-50901 in Harris County's 215th District Court with Judge Kerrylone Asbemy presiding over it.
