A Texas resident has filed a lawsuit after being injured in a dog attack, seeking justice and compensation for his suffering. On August 22, 2024, Alex Svetlitski filed a complaint in the Harris County District Court against Dixie Lee Carwile, Heather Neuse, Kimberly Carwile Middleton, and Carwile Country LLC.
According to the complaint, on December 23, 2023, Svetlitski was riding his bike near Jones State Road in Richards, Texas when he was charged by one or more dogs owned by the defendants. The dogs were not leashed or on the defendants' property at the time of the incident. One of the dogs collided with Svetlitski's bike tire, causing him to fall and sustain multiple injuries including fractured vertebrae. The plaintiff asserts that the defendants failed to properly restrain their dogs as required by Texas Health & Safety Code § 822 and Montgomery County Rabies Control and Animal Restraint Ordinance.
Svetlitski's petition claims that the defendants breached their legal duty to restrain their dogs and protect people from potential harm. "Defendants failed to properly train their dog(s), restrain the dog(s), or warn or protect people from the dog(s)," states the complaint. Furthermore, it alleges that at least one of the dogs had shown aggressive behavior prior to this incident. This negligence has led Svetlitski to suffer significant pain and suffering, medical expenses, disfigurement, mental anguish, economic loss, and other non-economic damages.
The plaintiff is seeking damages not exceeding $250,000 for his injuries and losses. He is also requesting pre-judgment interest from the date of injury through judgment date at the maximum rate allowed by law; post-judgment interest at the legal rate; court costs; and any other relief deemed appropriate by law or equity.
