Houston Resident Sues Three Companies Over Negligence Leading to Severe Injury

A Houston resident has filed a lawsuit against three companies, alleging negligence that led to a severe injury. Alberto Cavaa Vasquez lodged the complaint in the District Court of Harris County, Texas, on September 5, 2024, targeting Express Fuel, Inc., King Express, Inc., and Xclusive Trading Holdings, LLC.

The incident at the heart of this case occurred on December 4, 2022. Vasquez claims he tripped and fell on exposed screws at a property located at 3635 Aldine Mail Road in Houston. The plaintiff asserts that the defendants were aware or should have been aware of the hazardous condition but failed to take any corrective action. This alleged negligence resulted in significant personal injuries for Vasquez.

In his filing, Vasquez accuses the defendants of gross negligence and failing to provide a safe environment for their customers. "The incident was proximately caused by the negligence and gross negligence of the Defendants," reads the petition. Vasquez further contends that the defendants' failure to remedy the dangerous condition directly led to his injuries.

Vasquez is seeking monetary relief ranging from $250,000 to $1,000,000. He outlines several categories of damages including physical pain and mental anguish (both past and future), lost wages and loss of earning capacity (future), physical disfigurement (past and future), physical impairment (past and future), medical care costs (past and future), exemplary damages, and other allowable damages under law or equity. Additionally, he requests pre-judgment interest at the maximum legal rate.

Representing Vasquez is attorney Kraig L. Rushing from Rushing Law Firm based in Houston. The case has been assigned Case ID 2024-59588 and will be presided over by Judge Talitha McCarty in the 164th Judicial District Court.
