A warehouse accident has led to a lawsuit in Harris County, Texas, as a worker seeks justice for injuries sustained on the job. Baldemar Villarreal filed a complaint against North Fairbanks Owner LP in the District Court of Harris County on September 3, 2024.
According to the complaint, Villarreal was injured on April 12, 2024, while working at North Fairbanks' warehouse located at 7810 Fairbanks N. Houston Road in Houston. Employed by Staff Force Inc., Villarreal was unloading items from a truck when he stepped into an unmarked hole and fell backward. The plaintiff claims that despite raising concerns about safety hazards, the defendant failed to address them adequately. "Defendant failed to place any kind of ramp despite Plaintiff's several objections," the petition states.
Villarreal accuses North Fairbanks of negligence and premises liability, arguing that as the property owner and occupier, they had a duty to maintain safe conditions and inform him of any dangers. The lawsuit alleges that North Fairbanks knew or should have known about the hazardous condition but neither corrected it nor warned Villarreal. "Defendant either created the condition and/or failed to correct the condition or to warn Plaintiff about the dangerous condition," reads the filing.
The plaintiff is seeking monetary relief of $250,000 or less for damages including past and future medical expenses, pain and suffering, physical impairment, disfigurement, lost wages, and loss of earning capacity. Additionally, Villarreal demands judgment for all other relief deemed appropriate by the court.
Represented by Jesus A. Salinas from Daspit Law Firm, Villarreal is asking for pre-judgment and post-judgment interest along with court costs. The case is assigned Case ID 2024-58748 in the 127th Judicial District Court under Judge Wanda Chambers.
