Visitor Sues Holiday Attraction Owners Over Dangerous Conditions Leading to Severe Injury

A recent court filing reveals a gripping legal battle over a holiday attraction gone wrong. Lavanya Acharya filed a complaint in the District Court of Harris County, Texas, on September 5, 2024, against Magical Winter Lights, LLC and Chambers County Logistics Terminal, LP.

According to the complaint, Acharya visited the Magical Winter Lights holiday light show in Baytown, Texas on December 29, 2022. The plaintiff alleges that she was injured due to a deteriorated and deformed mat at an attraction called the Monkey Maze. After sliding down a slide and coming to rest on a mat at the end of it, Acharya claims her right ankle twisted due to the mat's condition, causing her to fall violently and sustain severe injuries. The lawsuit states that the defendants owned, operated, managed, and maintained the premises where this incident occurred.

Acharya argues that the defendants were negligent in several ways: they allowed dangerous conditions to persist without warning patrons or restricting access; they failed to place barriers or warning signs; and they did not maintain the premises in a reasonably safe condition. The plaintiff further contends that the defendants failed in their duty to hire adequately trained employees and exercise ordinary care in training and supervising them. This alleged negligence led directly to her injuries.

The plaintiff is seeking monetary relief exceeding $1 million for medical expenses (both past and future), physical pain and mental anguish (both past and future), disfigurement (both past and future), as well as pre-judgment interest, post-judgment interest, costs of court proceedings, and any other relief deemed just by the court.
