Grace Miller has filed a lawsuit against Goodwill Industries International, Inc., alleging negligence that resulted in personal injuries. The complaint was lodged on September 26, 2024, in the District Court of Harris County, Texas. Miller claims she was injured due to unsafe conditions at a Goodwill store.
The incident occurred on February 22, 2024, when Grace Miller visited a Goodwill store located at 21930 Kingsland Blvd., Katy, Texas. As an invitee on the premises, she expected a safe shopping environment. However, during her visit, she tripped over what appeared to be a rolled-up rug inside the store. This fall led to significant bodily harm and was attributed to an "unreasonably dangerous condition" that the defendant allegedly knew about but failed to rectify or warn customers about. The plaintiff argues that this oversight constitutes negligence on the part of Goodwill Industries International.
Miller's legal representation contends that her actions were reasonable and did not contribute to the accident or her injuries. She seeks compensation for various damages resulting from the incident. Specifically, Miller is asking for monetary relief under $250,000 for past and future medical expenses, physical pain and mental anguish, as well as physical impairment caused by the accident.
In addition to seeking compensatory damages for her injuries and suffering, Grace Miller has also requested disclosures from Goodwill Industries International under Rule 194 of the Texas Rules of Civil Procedure. These disclosures are intended to gather pertinent information and materials related to the case within fifty days of service.
The petition concludes with a prayer for judgment against Goodwill Industries International for actual damages proven at trial, along with prejudgment and post-judgment interest and court costs. Legal representation for Grace Miller is provided by Donald G. DeSimone of DeSimone Law Office in Houston, Texas.
This case is being overseen by Judge Marilyn Burgess in Harris County District Court under Case ID 2024-66174.
