Parkridge Community Association has taken legal action against a local property owner, accusing him of failing to meet his financial obligations to the community. The complaint was filed by Parkridge Community Association in the 165th Judicial District Court of Harris County, Texas, on September 27, 2024, targeting Francisco Jaimes as the defendant.
The case revolves around unpaid assessments and related charges that Francisco Jaimes allegedly owes to the Parkridge Community Association. According to the petition, Jaimes owns a property located at 3715 Golders Green Drive in Houston, Texas. This property is part of a subdivision governed by a set of conditions and restrictions known as the "Declaration," which requires all property owners within the community to pay assessments for communal upkeep and services. The Declaration also stipulates that failure to pay these assessments can result in additional charges such as interest and attorney fees, which are then added to the owner's account.
Parkridge Community Association claims that despite multiple notices sent to Jaimes regarding his delinquent account, he has failed to settle his debt. As per the association's records, Jaimes owes at least $3,709.83 in overdue assessments along with accruing interest and legal fees. The association argues that this amount continues to grow as time passes without payment.
In their filing, Parkridge Community Association seeks several forms of relief from the court. They are asking for a judgment against Jaimes for all outstanding amounts due, including future costs associated with collecting this debt. Furthermore, they seek permission from the court to foreclose on Jaimes' property if necessary and request an order for its sale should he remain non-compliant with payment obligations.
The association's attorneys emphasize their right under Texas law and their governing documents to recover reasonable attorney fees incurred while pursuing this matter legally. They have retained Holt & Tollett P.C., represented by J.C. Jamison, David K. Berk, Navin Pillai, and Rachael Chin as their legal counsel in this case.
This lawsuit highlights ongoing issues between homeowners' associations and residents over unpaid dues—a common point of contention that often leads communities into lengthy legal battles when amicable resolutions cannot be reached outside courtrooms.
The case is being presided over by Judge Christopher Matthews under Case ID 2024-66642 at Harris County's 165th Judicial District Court.
