Plaintiff (construction worker) sues Defendants (construction companies) for Negligence

A construction worker has filed a lawsuit against two companies, alleging negligence after a workplace accident left him seriously injured. Denes Vasquez Campos initiated the legal action on October 4, 2024, in the Harris County District Court against GZ Commercial Builders, LLC and UG Construction LLC, operating as Cardinal Construction.

According to the complaint, Campos was working at a construction site located at 1101 Gounah Street in Fort Worth, Texas on March 18, 2023. He was employed by Renato Gonzalez, a subcontractor hired by the defendants to provide services at this location. The plaintiff alleges that while he was working on a ten-foot scaffold to install another floor of the building under construction, there were no mobile harnesses or safety measures in place to prevent falls. As a result of this oversight, Campos suffered severe injuries when he fell from the scaffold.

The lawsuit accuses GZ Commercial Builders and UG Construction of failing to exercise reasonable care by not implementing necessary safety precautions such as barriers or harnesses on scaffolding. "Defendants had a duty to exercise the degree of care that a reasonably careful person would use to avoid harm," states the petition. Campos argues that his injuries were directly caused by what he describes as "negligent, careless, and reckless disregard" for safety protocols by the defendants.

In addition to negligence claims based on control over worksite conditions and methods, Campos also asserts premises liability negligence. He claims that the property posed an unreasonable risk due to lack of protective barriers and fall protection systems which should have been addressed by the defendants. The plaintiff contends that these omissions are violations of industry standards including those set by OSHA.

Campos is seeking monetary relief ranging from $1 million to $5 million for damages including past and future medical expenses, physical pain and suffering, mental anguish, loss of earning capacity and wages. He also seeks punitive damages for gross negligence exhibited by both companies involved.
