Healthcare Facility Accused of Negligence Leading to Patient's Death

A lawsuit has been filed against a healthcare facility, alleging negligence that led to the tragic death of a patient. Kim Reynolds Locascio, representing the estate of Paul L. Locascio, filed the complaint on October 4, 2024, in Harris County District Court against Wallisville Healthcare, LLC, doing business as EastView Healthcare & Rehabilitation Center.

The case centers around the unfortunate events following Paul Locascio's admission to EastView Healthcare & Rehabilitation Center after undergoing surgery for a fractured femur. Despite being identified as a high-risk fall patient and given a wristband indicating "Fall Risk," Mr. Locascio was reportedly not provided with adequate safety measures. On September 20, 2023, he informed his wife that his wheelchair had collapsed partially without any response from the nursing staff despite attempts to call for help. Tragically, on September 24, 2023, Mr. Locascio was found unresponsive on the floor next to his bed and later pronounced dead due to blunt force trauma resulting from a fall.

The plaintiff accuses EastView Healthcare & Rehabilitation Center of gross negligence and failing to provide necessary care and safety precautions for Mr. Locascio. The lawsuit claims that several negligent acts by the nursing staff contributed directly to Mr. Locascio's death. These include seating him in a faulty wheelchair, not responding promptly to emergency calls, failing to implement high-risk fall safety protocols such as bed rails or alarms, and generally neglecting their duty of care.

Kim Reynolds Locascio is seeking damages exceeding $1 million for past and future physical pain and suffering endured by Mr. Locascio before his death, medical expenses incurred during his treatment at EastView Healthcare & Rehabilitation Center, loss of earning capacity due to his untimely demise, funeral expenses, and loss of companionship among other claims.

Represented by attorneys Randall O. Sorrels and Gregory M. Garvin from Sorrels Law in Houston, Texas, Kim Reynolds Locascio seeks justice for her late husband through this legal action against Wallisville Healthcare LLC., which operates under the name EastView Healthcare & Rehabilitation Center.
