In a dramatic legal move, a former employee has taken action against his previous employer, alleging severe negligence that led to significant personal injury. Wilfredo Echeverria Flores filed a complaint on October 4, 2024, in the District Court of Harris County, Texas, against Sanitary Mattress Company doing business as Sleep Designs.

The case revolves around an incident that occurred on April 8, 2024. According to the complaint, Flores was working at the company's premises in Harris County when he was injured by falling wood while cutting materials for bed construction. The plaintiff claims that this accident resulted in "severe and excruciating" injuries to his left leg due to the alleged negligence of his employer. The lawsuit accuses Sanitary Mattress Company of failing to maintain a safe working environment and neglecting to implement adequate safety protocols. It further alleges that the company did not provide necessary training or supervision for its employees, which contributed directly to the hazardous conditions leading to Flores's injury.

Flores is seeking compensation for damages exceeding $200,000 but not more than $1 million. He argues that the defendant's actions were negligent and directly caused his injuries. The lawsuit highlights multiple areas where the company allegedly failed in its duty of care: inadequate safety measures, lack of proper employee training and supervision, and failure to warn about known dangers on the premises.

Additionally, Flores's petition emphasizes that Sanitary Mattress Company is a non-subscriber under Texas Labor Code § 406.003 because it did not have workers' compensation insurance at the time of the incident. This status prevents the company from using certain common law defenses such as contributory negligence or assumption of risk in this case.

The plaintiff seeks various forms of relief from the court including actual damages for past and future physical pain, mental anguish, loss of earning capacity, disfigurement, physical impairment, medical expenses, and other economic losses incurred due to his injuries. Furthermore, he requests both prejudgment and post-judgment interest as allowed by law along with court costs.

Representing Wilfredo Echeverria Flores is attorney Nicholas E. Campos from The Stano Law Firm located in Humble, Texas. As per court records under Case ID 2024-68894 assigned to Court No. 333 in Harris County District Court system presided over by Judge Nelson Cuero; this case will proceed with jury trial upon demand made by plaintiff’s counsel during filing process via eService platform utilized within local jurisdictional framework.
