Customer sues retail giant Walmart for negligence after slip-and-fall injury

Marleen Santos has filed a lawsuit against Walmart, Inc. and Wal-Mart Stores Texas, LLC, claiming negligence after suffering injuries from a slip-and-fall incident at one of their stores. The complaint was filed on October 11, 2024, in the District Court of Harris County, Texas.

According to the lawsuit, Marleen Santos was shopping at a Walmart Supercenter located at 15955 Farm to Market Road 529 in Houston, Texas on October 22, 2022. During her visit, she slipped on what is believed to be shampoo that had spilled onto the aisle floor. The suit alleges that there were no warning signs indicating the presence of the slippery substance and that Walmart failed to maintain safe conditions within the store. As a result of this incident, Santos claims she suffered serious bodily injuries due to Walmart's negligence.

The lawsuit accuses Walmart of several acts of negligence including allowing dangerous conditions to exist within their premises without proper inspection or warnings. Specifically, it states that Walmart failed to keep the store floor free from slippery substances and did not take reasonable measures to safeguard customers. Furthermore, it is alleged that Walmart's employees either knew or should have known about these hazardous conditions but did not act accordingly.

Santos is seeking monetary relief amounting to no more than $75,000 for damages which include past and future medical expenses, pain and suffering, physical impairment and disfigurement as well as lost wages and loss of earning capacity. Additionally, she requests pre-judgment and post-judgment interest along with court costs.

Representing Marleen Santos are attorneys Sarah Y-Nhi Huynh, Pavel "Paul" Savinov, and Michael Alvarez from The Huynh Law Firm PLLC based in Houston. The case has been assigned Case ID 2024-70978 and will be presided over by Judge Christopher Matthews in the 125th District Court of Harris County.
