Elsa Phillips, the widow of Gene Anthony Phillips Sr., has filed a lawsuit against two healthcare providers, alleging negligence that led to her husband's premature death. The complaint was lodged on November 1, 2024, in the District Court of Harris County against CCRC OpCo-Gleannloch Farms LLC and Trumen Physicians and Associates PLLC.
The case centers around allegations of medical negligence and wrongful death following Gene Anthony Phillips Sr.'s stay at The Village at Gleannloch Farms for rehabilitation after surgery. According to the petition, Mr. Phillips did not have any pressure injuries upon his admission but developed severe stage IV pressure ulcers during his stay. These injuries allegedly went undetected and untreated by the facility's staff, resulting in severe sepsis and ultimately his death. The plaintiffs claim that both Gleannloch Farms and Trumen Physicians failed to provide adequate staffing and medical care necessary to prevent such injuries.
Elsa Phillips is joined by her sons, Gene Anthony Phillips Jr. and Derek Jerome Phillips, as plaintiffs in this case. They argue that the defendants breached their duty of care by failing to initiate proper pressure injury prevention protocols, conduct regular skin checks, or adequately document Mr. Phillips' condition. Furthermore, they assert that the facilities were understaffed with unqualified personnel who could not meet the medical needs of their patients.
The plaintiffs are seeking unspecified damages within the jurisdictional limits of the court for economic losses, pain and suffering, mental anguish, loss of companionship, and other damages related to Mr. Phillips' untimely death. They also request pre-judgment interest from the date of injury through judgment day, post-judgment interest at legal rates, exemplary damages if applicable, costs of court proceedings, and any additional relief deemed fair by a jury.
