Plaintiff alleges grocery chain's negligence led to serious injuries

A slip-and-fall incident at a popular grocery store chain has led to a lawsuit filed in Harris County, Texas. Dimitris Warfield, the plaintiff, lodged a complaint against H-E-B, LP on November 1, 2024, alleging negligence after sustaining injuries from a fall at one of their Houston locations.

The case was filed in the District Court of Harris County under Case No. 2024-76655 and is being overseen by the 215th Judicial District. According to Warfield's petition, the incident occurred on November 19, 2022, when she slipped on a wet floor near the frozen meat section of an H-E-B store located at 12680 W Lake Houston Parkway. The floor was reportedly wet due to melted ice from pallets of frozen turkeys. Warfield claims that this negligence resulted in significant injuries to her lower back and knees.

Warfield's legal team argues that H-E-B failed in its duty to maintain safe premises for its customers. The petition states that "Defendant knew or reasonably should have known of the dangerous condition" and neglected to place any warning signs about the wet floor. Furthermore, it accuses H-E-B of gross negligence for not addressing an obvious hazard despite being aware of it. This lack of action is described as showing "conscious indifference to the rights, safety, or welfare of others."

In addition to premises liability and gross negligence claims, Warfield also accuses H-E-B of negligent hiring and supervision practices. The complaint alleges that H-E-B did not employ competent staff capable of ensuring customer safety and failed to provide adequate training or oversight.

Warfield seeks compensation for past and future medical expenses, physical pain and suffering, mental anguish, lost income, physical impairment, disfigurement, and both pre-judgment and post-judgment interest. She also requests exemplary damages exceeding $250,000 due to what she perceives as egregious conduct by H-E-B.

Representing Dimitris Warfield are attorneys Patrick O'Hara and Romin Tamanna from O’Hara Law Firm P.C., based in Houston. The case will be heard by Judge Tayler Hatcher in Harris County's 215th Judicial District Court under Case ID 2024-76655.
