Judge Sylvia A. Matthews | District Courts of Harris County

Sonia Ruiz De Jimenez has filed a lawsuit against a prominent Texas-based grocery chain, alleging negligence after suffering injuries from a fall in one of its stores. The complaint was filed on November 8, 2024, in the District Court of Harris County, Texas, naming H.E.B., Inc., doing business as Joe V’s, as the defendant.

The incident at the heart of this legal battle occurred on January 18, 2023, when Sonia Ruiz De Jimenez was shopping at a Joe V’s grocery store located at 5609 Uvalde Rd, Houston. While shopping for groceries, she unexpectedly slipped and fell on a slippery item that had been left unattended on the floor. The plaintiff claims there were no warning signs to alert customers to the hazard. As a result of this fall, she sustained significant bodily injuries.

Jimenez's petition accuses H.E.B., Inc. of negligence on several fronts. She asserts that as an invitee in the store, she was owed a duty of care by the defendant to maintain safe premises. The lawsuit outlines specific failures by H.E.B., including not removing or adequately marking the hazardous area with caution signs or barriers and failing to verbally warn customers about potential dangers. "Defendant breached its duty of ordinary care," states the petition, citing these omissions as direct causes of her injuries.

In terms of damages sought, Jimenez is requesting monetary relief exceeding $250,000 but not more than $1 million. She is also seeking compensation for past and future medical expenses related to her injuries and damages for physical pain and mental anguish suffered due to the incident. Additionally, Jimenez is pursuing pre-judgment and post-judgment interest as permitted by law.

Representing Sonia Ruiz De Jimenez is attorney Ebony Parks from the Law Offices of Domingo Garcia LLP based in Houston. The case has been assigned Case ID 2024-78789 and will be heard in Harris County's Judicial District Court.
