Channel Partners Capital, LLC has taken legal action against an individual for alleged breach of contract, seeking significant financial restitution. The complaint was filed by Channel Partners Capital, LLC in the District Court of Harris County, Texas on November 14, 2024, naming Clinton Mark Bergeron as the defendant.

The case revolves around a Master Equipment Finance Agreement that was entered into on September 26, 2023. According to the plaintiff, Channel Partners Capital (CPC), Clinton Mark Bergeron failed to fulfill his financial obligations under this agreement. The plaintiff claims that Bergeron defaulted on payments which were structured as one advance payment followed by sixty monthly installments. The total amount now claimed due by CPC is $58,725.97. As per the terms of the agreement, this default allows CPC to accelerate the maturity of the entire debt and demand immediate repayment along with the return of financed equipment.

In addition to breach of contract claims, CPC alleges that Bergeron also breached a Personal Guaranty Agreement signed on the same date as the finance agreement. This guaranty held Bergeron personally liable for debts incurred under the equipment financing arrangement. Despite multiple demands for payment and attempts to resolve these defaults amicably, CPC asserts that Bergeron has neither cured his defaults nor returned any equipment as stipulated in their agreements.

Channel Partners Capital is pursuing several forms of relief from the court. They seek a judgment for the outstanding balance of $58,725.97 plus pre-judgment and post-judgment interest as permitted by law. Additionally, they request compensation for all legal costs and attorneys' fees incurred in pursuing this matter. CPC also demands possession of the financed equipment as outlined in their original agreement with Bergeron.
