They were seated outside the Aloha Richmond's restaurant when a bench flipped unexpectedly as Nakie Martin attempted to sit beside Kimbella Walker-Adesiyan. This sudden mishap caused both individuals to fall and sustain injuries severe enough to require medical attention. The plaintiffs argue that the bench had been in a dangerous condition for an extended period and that Aloha Richmond should have been aware of this risk or had actual knowledge of it. They assert that they were invitees on the property and did nothing to contribute to the accident.
The lawsuit accuses Aloha Richmond of several acts of negligence. It is alleged that the company failed in its duty of care by not ensuring the safety of its premises for patrons like Martin and Walker-Adesiyan. Specifically, they accuse Aloha Richmond of not inspecting or warning about the hazardous condition posed by the bench and failing to make it safe. The plaintiffs argue that these breaches directly resulted in their injuries. As part of their legal action, they are seeking monetary relief under $250,000 for damages including physical pain and suffering, medical expenses incurred and anticipated future costs, as well as physical impairment.
