Tenant Alleges Negligence Against Apartment Complex After Wheelchair Fall

Juansley Smith has filed a lawsuit against LSC Encore, LLC, alleging negligence after a fall at his apartment complex left him with severe injuries. The complaint was filed in the District Court of Harris County, Texas, on November 20, 2024, naming LSC Encore, LLC as the defendant.

The incident in question occurred on August 12, 2023, when Juansley Smith fell from his wheelchair due to a missing concrete slab at the Encore on the Bay Apartments located at 4601 E Nasa Parkway in Harris County. Smith claims that this dangerous condition was known or should have been known by the defendant and their failure to address it constitutes negligence. The lawsuit details that the premises were not maintained safely and that there was a failure to correct or warn about the hazardous condition. As a result of this negligence, Smith sustained significant bodily injuries requiring medical treatment.

Smith is seeking monetary relief exceeding one million dollars for damages incurred due to his injuries. He argues that these injuries have had a lasting impact on his health and well-being and may require ongoing medical care. In addition to compensation for past and future medical expenses, Smith is also seeking damages for physical pain, mental anguish, physical impairment, and disfigurement both past and future.
