Dianne Marie Martinez has filed a lawsuit against Kindred Hospital Limited Liability Company, THC Houston, LLC, and Jones Lang LaSalle-Americas Inc., alleging negligence that led to her severe injuries. The complaint was filed in the District Court of Harris County, Texas, on November 22, 2024.
The case revolves around an incident that occurred on January 30, 2023, at Kindred Hospital Houston Northwest. Martinez claims she was seriously injured after tripping over metal trim on the premises—a condition she argues was hazardous and should have been addressed by the defendants. The fall resulted in a fractured right arm and wrist, along with other injuries to her shoulder, head, and face. According to the petition, the hospital is owned or controlled by Kindred Hospital Limited Liability Company and THC Houston LLC. Additionally, Jones Lang LaSalle-Americas Inc. is accused of failing in its duty to maintain the area where the accident happened.
Martinez's legal team asserts that all three defendants had a responsibility to ensure the safety of their premises but failed to do so. They argue that the defendants either created or neglected to remedy the dangerous condition or failed to warn Martinez about it. The petition states: "Defendants knew or should have known of the unreasonably dangerous condition and neither corrected nor warned Plaintiff of it." As a result of these alleged oversights, Martinez sustained significant injuries for which she seeks compensation.
The plaintiff is seeking damages exceeding $1 million for medical expenses, pain and suffering, physical impairment, disfigurement, mental anguish, lost wages, and loss of earning capacity.
