Plaintiff alleges healthcare provider discriminated against her based on pregnancy

Krystle Faulk has filed a lawsuit against Legacy Community Health Services, Inc., alleging discrimination based on pregnancy, disability, and gender. The complaint was lodged in the District Court of Harris County, Texas, on November 22, 2024. Faulk claims that her employment offer was rescinded due to her pregnancy-related complications and subsequent request for reasonable accommodation.

According to the petition, Krystle Faulk applied for a Laboratory Manager position with Legacy Community Health in June 2023. After an interview in August 2023, she received an employment offer from the defendant with a start date set for September 11, 2023. However, upon notifying Legacy of her need for temporary bed rest due to pregnancy complications on September 6, 2023, the company allegedly failed to engage in any interactive process to accommodate her condition. Instead, they rescinded her job offer two days later without exploring potential accommodations.

Faulk's legal action is grounded in multiple alleged violations: Chapter 21 of the Texas Labor Code which prohibits discrimination based on pregnancy and disability; Title VII of the Civil Rights Act concerning gender discrimination; and the Americans with Disabilities Act (ADAAA). She argues that despite being qualified for the position and capable of performing its duties remotely—knowledge gained from prior experience—the defendant refused to accommodate her or even consider her reapplication after her recovery.

The plaintiff seeks various forms of relief from the court including compensatory damages for pain and suffering as well as punitive damages. She also requests permanent injunctions preventing Legacy Community Health from engaging in discriminatory practices or denying reasonable accommodations to pregnant employees. Additionally, Faulk demands back pay, reinstatement or front pay in lieu of reinstatement, lost earnings and benefits both past and future, along with attorney’s fees and costs incurred during litigation.
