Hospital Visitor Alleges Negligence Against Healthcare Facility Over Unsafe Conditions

Dianne Marie Martinez has filed a lawsuit against Kindred Hospital Limited Liability Company, THC Houston, LLC doing business as Kindred Hospital Houston Northwest, and Jones Lang LaSalle-Americas Inc., alleging negligence after sustaining serious injuries on their premises. The complaint was filed in the District Court of Harris County, Texas, on November 22, 2024.

According to the petition, the incident occurred on January 30, 2023, at Kindred Hospital Houston Northwest located at 11297 Fallbrook Dr., Houston. Martinez claims she was an invitee on the premises when she tripped over metal trim that created a hazardous condition. This fall resulted in a fractured right arm and wrist along with other injuries to her shoulder, head, and face. She asserts that the defendants failed to maintain a safe environment and did not warn her of the dangerous condition despite knowing about it or having the responsibility to know about it. "Defendants either created the condition and/or failed to correct the condition or to warn Plaintiff about the dangerous condition," states Martinez's petition.

Martinez alleges that Kindred Hospital Limited Liability Company and THC Houston were negligent as owners and managers of the premises by not addressing or warning about the dangerous conditions. She also accuses Jones Lang LaSalle-Americas Inc., contracted for maintenance by Kindred and THC Houston, of failing in their duty to ensure safety by not resolving these hazards. The lawsuit outlines multiple instances of alleged negligence including failure to inspect or maintain safe walking conditions and inadequate employee training.

The plaintiff is seeking damages exceeding $1 million for medical expenses, pain and suffering, physical impairment, disfigurement, mental anguish, lost wages, loss of earning capacity among other reliefs deemed appropriate by a jury trial. The complaint emphasizes her right under U.S. and Texas constitutions for a jury to assess her damages.
