Insurance Agency Accused of Negligence After Visitor Injury

Plaintiff alleges negligence and premises liability against a local insurance agency and shopping center, seeking over $1 million in damages. On May 1, 2025, Rong Guan filed a complaint in the District Court of Harris County, Texas, against Fred Loya Insurance Agency, Inc., and LGN HW6 Center LLC.

The lawsuit stems from an incident on June 14, 2023, when Rong Guan was visiting the Fred Loya Insurance office located at 4025 Hwy 6 North in Houston. As he was walking outside the establishment, he tripped over a metal bolt protruding from the concrete sidewalk and suffered severe personal injuries. The plaintiff asserts that both defendants were responsible for maintaining the premises and had actual knowledge of the dangerous condition but failed to take necessary precautions or provide adequate warnings to prevent harm. "Defendants' failure to use the care warranted under the circumstances was a proximate cause of Plaintiff's injuries," states the petition.

Guan's legal team argues that both Fred Loya Insurance Agency and LGN HW6 Center LLC breached their duty of care by neglecting to inspect and maintain safe conditions on their property. The lawsuit lists several specific acts of negligence including failing to repair or warn about the hazardous condition, not roping off the area, and allowing bolts to protrude dangerously above the sidewalk surface. Each act is claimed to have contributed directly to Guan's injuries.

In his plea for relief, Guan seeks various forms of compensation for past and future damages resulting from his injuries. These include medical expenses, mental anguish, physical impairment, disfigurement, pain and suffering, pecuniary loss as well as exemplary damages meant to punish gross negligence. Additionally, he requests pre-judgment and post-judgment interest along with court costs.
