Anita Dawson filed a complaint against Whole Foods Market Rocky Mountain/Southwest, L.P., and its associated entities on December 12, 2024. According to the complaint filed by Anita Dawson, she was injured on January 15, 2023, while visiting a Whole Foods Market located at 1700 Post Oak Blvd., Houston, Texas. Dawson claims she tripped and fell due to an uneven floor as she exited the bathroom. She asserts that the defendants failed to warn her about this hazardous condition. The lawsuit accuses Whole Foods Market Rocky Mountain/Southwest and its related companies of negligence for creating an unsafe environment that posed an unreasonable risk to visitors. "The Defendants knew or should have known of this unsafe condition but failed to remedy or warn patrons," the petition states.
Dawson's complaint further alleges that the negligence of Whole Foods Market resulted in significant injuries for which she seeks compensation. She is pursuing damages for physical pain and mental anguish both past and future, lost wages and loss of earning capacity in the future, physical disfigurement and impairment past and future, medical expenses past and future, exemplary damages, and other damages permitted by law. The plaintiff has declared that she is seeking monetary relief exceeding $250,000 but not more than $1 million.
