On December 18, 2024, Jacinta Valle Reynolds submitted her complaint in the District Court of Harris County, Texas, targeting The Home Depot USA, Inc., doing business as The Home Depot 565.
The case stems from an incident on December 14, 2023, when Reynolds visited The Home Depot store located at 5455 Fairmont Parkway in Pasadena, Texas. According to the petition, while in the designated pickup area of the store's premises, Reynolds slipped and fell on an unknown liquid substance while attempting to load a refrigerator into her vehicle. This fall resulted in bodily injuries for which she holds The Home Depot accountable. Reynolds claims that as an invitee on the premises for mutual benefit with the store, she was owed a duty of care by the retailer.
Reynolds accuses The Home Depot of failing to maintain safe conditions on their property and alleges several breaches of duty. She asserts that there were no warnings or barriers placed around the hazardous area and that The Home Depot did not adequately inspect or maintain its premises to prevent such accidents. "Defendant had a duty to use ordinary care," states the petition, emphasizing failures like not cleaning up the liquid substance or warning customers about it.
The lawsuit seeks monetary relief exceeding $250,000 but not more than $1 million. Reynolds is asking for compensation covering past and future medical expenses, physical pain and mental anguish, physical impairment, and loss of household services due to her injuries.
