A woman has filed a lawsuit against three companies, alleging negligence after she suffered significant injuries from slipping on wet paint in a parking lot. Janett Arzaga filed the complaint in Harris County District Court on December 26, 2024, against Farah Investments, LLC; York Realty Investment, LLC; and Kroger Texas, LP.
The case stems from an incident that occurred on February 23, 2023, when Arzaga was visiting a shopping center at 2619 Red Bluff in Pasadena, Texas. As she exited the Kroger store located within the premises owned and managed by the defendants, she slipped on wet paint in the parking lot. According to Arzaga's complaint, there were no warning signs indicating the presence of wet paint. The plaintiff argues that as an invitee at the time of her injury, the defendants owed her a duty of care to maintain safe conditions on their property and failed to do so.
Arzaga claims that her fall resulted in severe injuries to her right shoulder, hip, ankle, and wrist. She contends that these injuries are permanent and have caused her ongoing pain and suffering. The lawsuit accuses the defendants of several negligent acts including failing to warn about or remedy dangerous conditions like wet paint in pedestrian areas. Furthermore, it alleges that they did not implement adequate safety procedures or employ competent staff to prevent such hazards.
The plaintiff is seeking various forms of relief from the court. She demands compensation for past and future medical expenses related to her injuries as well as damages for physical disfigurement and impairment. Additionally, Arzaga seeks punitive damages due to what she describes as gross negligence by the defendants. Her petition specifies monetary relief sought is $250,000 or less but leaves exact amounts for determination by a jury.
