Shopper Sues Grocery Chain H-E-B for Negligence After Slip-and-Fall Incident

A shopper's routine visit to a local grocery store turned into a legal battle when she suffered injuries from a slip and fall incident. Digna Marquez filed a complaint against H-E-B, LP in the District Court of Harris County, Texas on December 27, 2024. The lawsuit accuses the grocery chain of negligence leading to her injuries.

The plaintiff, Digna Marquez, claims that on August 23, 2023, she was shopping at an H-E-B store located at 1550 N. Fry Rd., Houston, Texas when she slipped on a liquid substance left on the floor by an employee. Marquez asserts that there were no warning signs present to alert customers of the hazard. She argues that at least one employee was aware of the dangerous condition but failed to address it or warn patrons like herself. This oversight is central to her premises liability claim against H-E-B.

Marquez contends that as an invitee, she had every right to expect a safe shopping environment. Her petition states that "Defendant knew, or should have known," about the hazardous condition and neglected their duty to maintain safety standards within their premises. The plaintiff's allegations hinge on common law premises liability principles which hold property occupiers accountable for ensuring visitor safety.

The damages Marquez seeks are extensive and include compensation for past and future medical expenses, pain and suffering, mental anguish, and lost wages due to her injuries. Additionally, she requests recovery of court costs as well as pre- and post-judgment interest from H-E-B. In total, Marquez is seeking monetary relief not exceeding $250,000 but reserves the right to adjust this amount based on further evidence presented during trial proceedings.
