Ana Ventura has filed a lawsuit against a major Texas-based grocery chain, alleging negligence that led to her injuries. The complaint was filed by Ventura in the District Court of Harris County, Texas, on December 27, 2024, targeting H-E-B, LP as the defendant.
According to the court documents, Ana Ventura claims that on May 30, she visited an H-E-B store located at 10100 Beechnut Street in Houston as an invitee intending to shop. During her visit, she slipped and fell due to a liquid substance left on the floor by one of the store's employees. Ventura asserts that there were no warning signs indicating the presence of the hazardous condition. "Plaintiff did not know that the liquid in Defendant's store was on the floor that she was walking on," states the complaint. She argues that H-E-B failed in its duty to maintain a safe environment for its customers or adequately warn them about potential dangers.
The legal basis for Ventura's case is grounded in premises liability under common law. As an invitee, she contends that H-E-B had a responsibility to ensure their premises were safe and free from hazards. The lawsuit accuses H-E-B of being aware of the dangerous condition since it was created by their employee yet neglecting to address it or warn customers like Ventura. Ventura is seeking various forms of relief from the court. She demands actual and special damages not exceeding $250,000 for medical expenses both past and future, pain and suffering, mental anguish, and lost wages due to her injuries.
