A Beaumont resident has filed a lawsuit against a popular restaurant chain, claiming negligence after a slip-and-fall incident that resulted in multiple injuries. Susan Truss initiated the legal action against Saltgrass, Inc., filing her complaint on December 26, 2024, in the District Court of Harris County, Texas.
The case stems from an incident on May 13, 2023, when Susan Truss visited the Saltgrass Steak House located at 4400 East Freeway in Baytown, Texas. According to the complaint, Truss slipped on an unknown liquid while making her way to the restroom after dinner. The fall resulted in significant injuries to her left side, including contusions and pain that required medical attention. Despite her discomfort and visible injuries, she alleges that no caution signs were present at the time of her fall. An employee witnessed the event but did not complete an incident report; instead, she was given a business card by manager Mitchell Merbach.
Truss claims that the lack of warning signs and inadequate response from staff constitute negligence and premises liability on behalf of Saltgrass, Inc. She argues that as an invitee on their premises, she was owed a duty of care which was breached by failing to maintain safe conditions or adequately warn patrons of potential hazards. Her legal representation asserts that this breach directly caused her injuries and subsequent suffering.
The plaintiff is seeking damages within the jurisdictional limits of the court—ranging from $250,000 to $1 million—to cover medical expenses incurred and anticipated future costs due to ongoing pain and impairment. She also seeks compensation for physical pain and suffering endured since the accident occurred.
Representing Susan Truss is attorney E. Hart Green from Weller, Green, Toups & Terrell L.L.P., based in Beaumont. The case has been assigned Case ID 2024-88952 in Harris County's 80th Judicial District Court.
