Maria Magdalena Fernandez has filed a lawsuit against several companies following an incident that left her injured. The complaint was lodged on December 31, 2024, in the District Court of Harris County, Texas, targeting Molan Group LLC, Welltower OM Group LLC, and Gamma Construction Company. Fernandez claims these entities are responsible for the unsafe conditions that led to her fall and subsequent injuries.
The case stems from an incident on May 2, 2023, when Maria Magdalena Fernandez visited the Kelsey Seybold Clinic in League City, Texas. Owned by Molan Group LLC and/or Welltower OM Group LLC, the premises were undergoing construction work managed by Gamma Construction Company. As Fernandez walked through the parking lot towards her appointment, she slipped on loose gravel allegedly left by the construction activities. The absence of warning signs or barriers around this hazardous area is central to her claim. "There were no signs posted nearby to warn invitees such as Plaintiff of the unreasonably dangerous condition posed by the loose gravel," states the petition.
Fernandez accuses the defendants of negligence for failing to maintain a safe environment for visitors. She argues that they should have been aware of the risks posed by loose gravel and taken measures to prevent accidents. Her allegations include failing to place caution signs or barriers and not verbally warning visitors about potential dangers. The plaintiff contends that these oversights directly resulted in her fall and subsequent injuries.
In seeking justice, Fernandez requests monetary compensation ranging from $250,000 to $1 million for damages incurred due to physical pain, mental anguish, and medical expenses related to her injuries. She also seeks pre-judgment interest as part of her damages claim. Furthermore, she reserves the right to amend her petition as more information becomes available through ongoing investigations and discovery processes.
