Customer Sues Major Pharmacy Chain for Negligence After Fall

A woman has filed a lawsuit against a major retail pharmacy chain, alleging negligence after suffering injuries from a fall at one of their stores. Clementina Saucedo initiated the legal action against Walgreen Co., filing her complaint on January 3, 2025, in the District Court of Harris County, Texas.

According to the court documents, Saucedo claims that on April 28, 2023, she was an invitee at a Walgreens store located at 5161 Franz Road in Katy, Texas. As she approached the entrance of the store, she tripped over a raised curb in a handicap parking spot. The lawsuit alleges that this curb was not designed according to ADA guidelines, creating a hazardous condition for customers. Saucedo accuses Walgreens of premises liability due to several factors: failing to maintain safe conditions on their property, neglecting to inspect and correct dangerous conditions, and not providing adequate warnings about potential hazards. "Defendant owed Plaintiff a duty to warn and make safe the defective condition existing on Defendant’s premises," states the petition.

Saucedo is seeking monetary relief not exceeding $75,000 for various damages including physical pain and mental anguish both past and future, loss of earning capacity and wages both past and future, disfigurement and physical impairment both past and future, as well as medical expenses incurred due to her injuries. She demands a jury trial to resolve these issues.

The case is being handled by attorneys Sarah Y-Nhi Huynh, Pavel “Paul” Savinov, Michael Alvarez from Huynh Law PLLC; along with Hilda Leonor Sibrian from The Law Offices of Hilda L. Sibrian P.C. The case is filed under Cause No. 2025-00326 in the 190th Judicial District Court of Harris County.
