Luis Alberto Hernandez has filed a lawsuit against RDT Construction Inc., alleging negligence after sustaining injuries on a construction site. The complaint was filed in the District Court of Harris County, Texas, on January 3, 2025. Hernandez claims that the company failed to ensure a safe working environment, which led to his accident and subsequent injuries.
According to the petition, Luis Alberto Hernandez was injured on May 9, 2024, while working at a construction site located at 12450 N Lake Houston Parkway in Houston, Texas. The incident occurred when a saw he was using allegedly malfunctioned and cut into his leg. Hernandez contends that this accident happened under the supervision of RDT Construction's employees. He accuses the company of negligence for not providing a safe working environment and failing to prevent foreseeable risks. "Defendant owed Plaintiff a duty to exercise reasonable care," states the petition, accusing RDT Construction of breaching this duty by not taking adequate safety measures.
Hernandez's legal team argues that RDT Construction maintained control over the worksite and the activities conducted thereon. They assert that the company had both actual and constructive knowledge of unsafe conditions but did not take steps to mitigate these risks. The lawsuit further alleges premises liability, stating that an unreasonable risk of harm existed on-site due to defects or dangerous conditions known by RDT Construction. Moreover, it is claimed that the defendant's negligent actions were within their employees' scope of employment and thus make them vicariously liable under Respondeat Superior.
The plaintiff seeks monetary compensation ranging from $250,000 to $1 million for damages incurred due to medical expenses, pain and suffering, loss of earning capacity, mental anguish, disfigurement, and other related losses. In addition to financial restitution for past and future damages, Hernandez demands attorney fees and interest as permitted by law.
