Kerim Susana Vasquez Perez filed a complaint against Home Depot of Texas Inc. and Home Depot U.S.A., Inc. on January 10, 2025, in the District Court of Harris County. The case centers around an incident that occurred at one of the defendant's stores, which the plaintiff claims resulted in serious bodily injuries.
The lawsuit stems from an incident on February 19, 2024, when Vasquez Perez was shopping at a Home Depot store located at 6800 Highway 6 North in Houston, Texas. According to the petition, while reaching for wood pieces from one of the store's bays, the improperly placed materials shifted and struck her face and body. The plaintiff accuses Home Depot of negligence for allowing dangerous conditions to exist within their premises without adequate warning or corrective measures.
Vasquez Perez argues that Home Depot failed to exercise ordinary care by not maintaining a safe environment for customers. She alleges that the company did not properly stack wood pieces or provide warnings about potential hazards despite being aware—or reasonably expected to be aware—of such dangers. "Defendants owed a duty to exercise ordinary care to keep the premises in a reasonably safe condition," states the complaint.
The plaintiff is seeking monetary relief not exceeding $75,000 as per Texas Rule of Civil Procedure 47(c). This amount includes damages covering past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, lost wages, and loss of earning capacity. Additionally, Vasquez Perez demands pre-judgment interest and post-judgment interest along with any other relief deemed appropriate by the court.
