Plaintiff Injured Worker Sues Construction Business for Negligence

Orlin Javier Aguilar Lopez has filed a lawsuit against Santos Cristina Sotero Espinal, doing business as Brother’s Tile, following a severe workplace injury. The complaint was filed on January 24, 2025, in the District Court of Harris County, Texas. Aguilar Lopez alleges that the defendant's negligence led to his injury while working at their job site.

The incident occurred on November 8, 2023, when Aguilar Lopez was operating a table saw provided by Brother’s Tile. According to the petition, the saw lacked a crucial safety feature—a blade guard—which resulted in Aguilar Lopez suffering serious injuries to his hand. The plaintiff contends that these injuries have had life-altering consequences and holds the defendant responsible for failing to provide a safe working environment.

Aguilar Lopez accuses Brother’s Tile of multiple counts of negligence. He claims they failed to properly train and supervise him and neglected to recognize and rectify unsafe conditions at the job site. Additionally, he argues that they did not provide adequate safety rules or procedures and failed to ensure that the tools and equipment were safe for use. The plaintiff asserts that these failures directly contributed to his injuries.

In seeking justice, Aguilar Lopez is asking for monetary relief exceeding $550,000 but not more than $1 million. This amount includes damages for past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, lost wages, and loss of earning capacity. Furthermore, he demands pre-judgment interest and all other relief deemed appropriate by the court.
