Alvina Lopez has filed a lawsuit against LJX Enterprises, LLC, doing business as Spanish Flowers Restaurant, and Spanish Flowers, Inc., alleging negligence after a severe fall at the restaurant premises. While descending a staircase at the restaurant located at 4701 North Main Street in Houston, she stepped on a broken tile which caused her to fall into an iron fence. This incident resulted in significant injuries including damage to her left shoulder, back, knee, and head. Lopez asserts that these injuries required emergency medical attention and months of recovery. She accuses the defendants of having actual or constructive knowledge of the hazardous condition posed by the broken tile but failing to address it adequately.
Lopez's lawsuit outlines several accusations against LJX Enterprises and Spanish Flowers Inc., including negligence and gross negligence. She argues that the defendants owed her a legal duty as an invitee on their premises but failed to exercise reasonable care by not repairing or warning about the dangerous condition. The plaintiff further alleges that this negligence was both a proximate cause and producing cause of her injuries.
