Plaintiff alleges oil company’s negligence after slip-and-fall incident

Patrick Wood has taken legal action against a major oil company, alleging negligence after a slip-and-fall incident at one of its gas stations. The complaint was filed by Patrick Wood in the District Court of Harris County, Texas, on February 13, 2025, targeting Shell Oil Company as the defendant.

The lawsuit stems from an incident that occurred on March 7, 2023, when Patrick Wood visited a Shell Gas Station located at 14760 Wallisville Road in Houston, Texas. During his visit, Wood slipped on a wet substance on the floor and fell onto shelves before hitting the ground. He claims he was unaware of the wet floor until it was too late. According to the petition, "This wet floor created an unsafe and hazardous condition on Shell Gas Station premises that Defendant either knew existed or should have known existed." The plaintiff accuses Shell Oil Company of failing to provide any warning signs or indicators to alert him of the potential danger.

Wood's complaint further alleges that Shell Oil Company's negligence led to his injuries. The petition states that "the incident was proximately caused by the negligence and gross negligence of Defendants in creating and/or allowing to exist a condition on the premises that posed an unreasonable risk of harm to visitors." The plaintiff argues that Shell Oil Company had a duty to ensure their premises were safe for customers and failed in their responsibility by not addressing or warning about the dangerous condition.

In addition to negligence claims, Wood also asserts premises liability against Shell Oil Company. He maintains that as an invitee on their property, he was owed a duty of care which included inspecting and maintaining safe conditions. However, according to Wood's filing, "Defendant's agents negligently or willfully allowed such conditions to continue and failed to warn Plaintiff."

Wood is seeking monetary relief ranging from $250,000 to $1 million for damages including physical pain and mental anguish both past and future, lost wages and earning capacity, medical expenses past and future, as well as exemplary damages. Furthermore, he requests pre-judgment interest at the maximum legal rate along with post-judgment interest.

Representing Patrick Wood are attorneys Adam Miller and Daniel Weisfeld from Miller Law LLP based in Houston. They have requested that Shell Oil Company be cited to appear in court for this case identified under Case ID: 2025-19054 before Judge Marilyn Burgess.
