Plaintiff alleges supermarket chain over negligent security after violent attack

In a gripping legal battle unfolding in Harris County, Texas, a plaintiff has filed a lawsuit against several businesses and property companies following a violent incident on their premises. Irlanda Abigail Cazares initiated the complaint on April 25, 2025, targeting defendants including Supermercado El Rancho, Inc., Mexico Foods, LLC, Oaxaca Foods, LLC, Khaled Properties, LLC, and Mario Properties, LLC. The case is rooted in an alleged assault and robbery that occurred on April 30, 2023.

The lawsuit details the events leading up to the incident where Cazares was reportedly beaten and robbed while visiting one of the defendants' properties located at 11303 Texas. The plaintiff accuses the defendants of failing to provide adequate security measures to prevent such occurrences. According to the petition filed by Cazares' attorney Kraig L. Rushing from Krushing Law Firm, "there was such a probability of a harmful event occurring that a reasonably prudent person would have foreseen that the conduct just described or some similar event was likely to happen." The plaintiff claims that despite this foreseeable risk, the defendants neglected to upgrade or maintain security on their property.

Cazares is pursuing several causes of action against the defendants including premises liability and negligence. She argues that the defendants failed in their duty to maintain safe conditions by not inspecting for dangerous situations or warning visitors about potential hazards. Furthermore, Cazares alleges gross negligence on part of the defendants for acting with "such an extreme degree of careless and reckless behavior as to constitute conscious indifference to the safety" of visitors like herself.

In terms of relief sought from the court, Cazares is requesting monetary compensation ranging between $250,000 and $1 million for damages suffered due to physical pain and mental anguish both past and future. Additionally, she seeks compensation for lost wages and earning capacity along with medical expenses incurred as a result of her injuries. Exemplary damages are also being pursued given what is described as reckless disregard for safety by those responsible for maintaining secure premises.
