A Texas resident has filed a lawsuit against a local company and its owner, alleging negligence that resulted in severe injuries during a home remodeling project. Leny A. Santos Alvarado submitted the complaint on February 11, 2025, in the District Court of Harris County, Texas, targeting Mircea Osvath and OMV & Company, Inc.

The case revolves around an incident that occurred on June 5, 2023, when Alvarado was working on a second-floor remodeling project at a property owned by the defendants. According to the petition, Alvarado fell from a height of ten feet due to the absence of safety rails and lack of warning signs about unsafe conditions. The plaintiff claims he was an invitee at the premises and accuses the defendants of failing to provide a safe environment or adequate warnings about potential hazards. "Defendants breached this duty not only by failing to provide a safety rail... but also by failing to warn him of the unreasonably dangerous condition," states the petition.

Alvarado's legal team argues that both Mircea Osvath and OMV & Company are liable under several legal theories including negligence, premises liability, negligent maintenance, and failure to warn or repair. The plaintiff alleges that the defendants were aware or should have been aware of the hazardous conditions but neglected their duty to correct them or inform those present on-site. Furthermore, it is claimed that these actions were not isolated incidents but part of broader negligence patterns leading up to Alvarado's fall.

The plaintiff seeks monetary relief exceeding $1 million for medical expenses incurred due to injuries sustained in his head, neck, spine, shoulders, arms, wrists, back, hips, legs, and ankles. He also demands compensation for physical pain and suffering both past and future; loss of earnings; mental anguish; fear of future disease; costs associated with monitoring his health moving forward; and exemplary damages for what he describes as conscious indifference shown by the defendants towards his safety.

In addition to financial compensation for damages suffered as a result of alleged negligence by OMV & Company Inc., Alvarado requests exemplary damages due to what he describes as an extreme degree of risk created by defendant’s actions considering potential harm involved—actions which he claims demonstrated conscious indifference towards rights/safety/welfare others involved.
