A woman has filed a lawsuit against two businesses in Harris County, Texas, after sustaining injuries on their premises. On March 6, 2025, Nalda Gonzalez Morales lodged a complaint in the District Court of Harris County against TCH Pediatric Associates, Inc., and Macey Interests, LP. The plaintiff alleges negligence on the part of the defendants, leading to her injuries.
According to the complaint, Morales was an invitee at the defendants' business located at 14730 Barryknoll Lane in Houston when she tripped over a broken piece of wood protruding from the concrete. This incident occurred in May 2024. Morales claims that this hazardous condition was due to negligence by TCH Pediatric Associates and Macey Interests in maintaining safe premises for their customers. The plaintiff asserts that the defendants failed to use ordinary care in ensuring their premises were reasonably safe or warning her about dangerous conditions present.
The lawsuit outlines several accusations against the defendants: failing to maintain a safe environment free of hazards, not correcting dangerous conditions, neglecting to warn customers like Morales about these dangers, inadequate inspection practices to discover such hazards, insufficient employee training on maintaining safety standards, and lack of proper policies and procedures for ensuring safety. Morales is seeking damages for medical expenses incurred due to her injuries as well as anticipated future medical costs. She also seeks compensation for physical pain and suffering experienced both past and future, mental anguish endured as a result of the incident, loss of earnings and earning capacity due to her injuries, physical impairment suffered from the accident with potential future implications, and any disfigurement resulting from her fall.
The plaintiff is asking for a sum exceeding $250,000 but not more than $1 million as determined by a fact finder at trial. Additionally, she requests pre-judgment and post-judgment interest at the highest legal rate allowed by law along with court costs.
