Plaintiff alleges logistics companies' negligence led to severe injury

A truck driver has filed a lawsuit against two logistics companies, alleging negligence that led to severe personal injuries. On March 7, 2025, Yurii Pavlichko filed a complaint in the District Court of Harris County, Texas, against AMUL Logistics Corp. and Safe Way Carrier LLC. The case highlights the dangers faced by employees when employers allegedly fail to provide necessary training and equipment for safe work practices.

According to the complaint, Pavlichko was employed as a truck driver by Safe Way Carrier LLC and was also associated with AMUL Logistics Corp., acting as a borrowed or dual employee. On December 21, 2024, while performing his duties in Minnesota, Pavlichko was instructed to conduct a load swap without adequate assistance or equipment. This task was outside his job description and expertise as he had not received training in handling heavy loads. During this process, a twenty-foot-long pipe weighing approximately 3,800 pounds rolled onto his hand, causing severe fractures that required surgical intervention.

Pavlichko's complaint details how he reported the injury to his employer but received no immediate assistance or medical aid. Instead, he was advised to seek medical attention only after returning to Texas. His subsequent visits to healthcare facilities confirmed the severity of his injuries, necessitating surgery on his fractured middle finger.

The plaintiff accuses both AMUL Logistics Corp. and Safe Way Carrier LLC of negligence under several counts: dispatching him for dangerous work without proper training or equipment; failing to provide a safe working environment; negligent hiring and supervision of employees; and more. As non-subscribers under the Texas Workers’ Compensation Act, these companies have forfeited common law defenses such as contributory negligence and assumption of risk by the employee.

Pavlichko seeks monetary relief exceeding $1 million for damages including past and future medical expenses, pain and suffering, physical impairment and disfigurement, lost wages, and loss of earning capacity. He demands a jury trial to adjudicate these claims.

Represented by attorney Kiernan McAlpine from McAlpine Law Firm in Houston, Texas, Pavlichko aims for justice through compensation for his injuries caused by alleged employer negligence. The case is presided over by Judge Nelson Cuero in the 61st Judicial District Court under Case ID 2025-15789.
