Plaintiff Alleges Negligence Against Energy Steel Products Following Workplace Injury

Edgar Vazquez has taken legal action against a steel products company and one of its employees following a serious workplace incident. On March 14, 2025, Vazquez filed a complaint in the District Court of Harris County, Texas, accusing Energy Steel Products LLC and Cullen Johnson of negligence that led to his severe injuries. The case sheds light on workplace safety concerns and the responsibilities of employers to ensure a safe working environment.

According to the complaint filed by Edgar Vazquez, he was injured on October 31, 2024, while performing his duties at the warehouse of ESP Specialty Steel Products in Houston. Vazquez was struck in the head by a crane hook operated by Cullen Johnson, an employee of ESP Specialty. The plaintiff claims that Johnson's failure to maintain proper lookout and attention resulted in this accident. "Defendant Johnson failed to keep a proper lookout...resulting in Defendant Johnson striking Plaintiff's head with a crane hook," states the petition. As a result of this alleged negligence, Vazquez suffered significant head and neck injuries.

The lawsuit also highlights allegations against Energy Steel Products LLC for inadequate training and supervision of its employees. The plaintiff asserts that the company failed to implement adequate safety protocols and did not properly train or supervise its staff, which contributed to the incident. "Defendant ESP Specialty had a duty...to protect from and/or avoid harm to others," reads the complaint. Vazquez is seeking over $1 million in damages for medical expenses, pain and suffering, mental anguish, lost wages, loss of earning capacity, and other related costs.

In addition to compensatory damages, Vazquez is pursuing exemplary damages due to what he describes as gross negligence on the part of both defendants. He argues that their actions demonstrated an extreme degree of risk without regard for his safety or well-being. "Defendants had actual awareness of the risk but proceeded with conscious indifference," claims the lawsuit.
