In a compelling legal battle that could have significant implications for property management companies, Lorena Salazar has filed a lawsuit against Zainab Investments, LP and Lyerly Management, LLC. The complaint was lodged on March 28, 2025, in the District Court of Harris County, Texas. The defendants are accused of negligence after Salazar suffered severe injuries due to unsafe conditions on their premises.
The case stems from an incident on December 29, 2023, when Lorena Salazar fell in the parking lot of the defendants' property located at 903 Crosstimbers Street in Houston. According to the complaint, Salazar's fall was caused by dangerous pavement conditions that the defendants were allegedly aware of but failed to address. "Defendants knew or reasonably should have known the danger posed by these conditions," asserts the petition. As a result of this negligence and gross negligence, Salazar sustained serious injuries requiring extensive medical treatment.
Salazar's lawsuit highlights several key legal points: she was an invitee on the premises and thus owed a duty of care by the property owners. The complaint argues that Zainab Investments and Lyerly Management breached this duty by not maintaining safe conditions or providing adequate warnings about potential hazards. Furthermore, it accuses them of gross negligence and malice for acting with conscious indifference to the risks posed by their failure to maintain safe premises.
The plaintiff is seeking various forms of relief from the court. These include actual and economic damages for past and future medical expenses, pain and suffering, physical impairment, lost earning capacity, mental anguish, as well as pre-judgment and post-judgment interest at the highest rate authorized by law. Additionally, Salazar is pursuing punitive damages under §41.000 et seq., of the Texas Civil Practice & Remedies Code due to what she describes as intentional or reckless conduct by the defendants.
