Plaintiff alleges negligence against furniture retailer following recliner collapse

Ivanna Lopez has filed a lawsuit against Texas Forty-Five North, LLC, doing business as The Dump Furniture Outlet, alleging negligence after a recliner incident left her injured. The complaint was lodged in the District Court of Harris County, Texas on March 28, 2025. Lopez claims that the defendant's failure to properly assemble furniture led to her fall and subsequent injuries.

The lawsuit centers around an incident that occurred on July 29, 2023, at The Dump Furniture Outlet located at 10251 North Freeway, Houston, Texas. Ivanna Lopez visited the store as a customer intending to purchase furniture for her home. While trying out a recliner model on display, the furniture unexpectedly collapsed under her weight. At the time of the accident, Lopez was eight months pregnant and sustained significant injuries due to the fall. Lopez's petition accuses Texas Forty-Five North, LLC of premises liability and negligence. It states that employees failed to address or warn about the dangerous condition posed by improperly assembled furniture. The plaintiff argues that this oversight constituted a breach of duty owed to her as an invitee and business patron of the store. Furthermore, she alleges negligent hiring and training practices contributed to inadequate safety measures at the premises.

In seeking redress from the court, Lopez requests monetary relief exceeding $250,000 but less than $1 million for medical expenses incurred due to her injuries and other damages such as pain and suffering, mental anguish, lost earnings, disability, impairment, disfigurement, and out-of-pocket expenses related to the incident. She also demands pre-judgment interest from the date of injury through judgment date and post-judgment interest along with costs of court proceedings.
