In a compelling legal battle, a mother has taken action against a retail giant following an incident that left her child injured. Lindsey Michelle Conway, acting as the next friend of her minor child L.C., filed a lawsuit against Walmart Inc. in the District Court of Harris County, Texas on March 27, 2025. The case arises from an unfortunate event that occurred on April 15, 2023, at a Walmart store located in La Porte, Texas.
According to the court documents, Lindsey Michelle Conway alleges that while visiting Walmart #5116 with her child, L.C., they encountered a hazardous condition on the premises. The petition states that L.C. slipped and fell due to an unidentified slippery substance on the floor, which was not marked by any caution signs or warnings. As a result of this fall, L.C. sustained multiple injuries. Conway claims that Walmart failed in its duty to maintain safe premises for its customers and seeks justice for her child's suffering.
The lawsuit accuses Walmart of negligence and breach of duty by failing to implement adequate safety measures and failing to warn patrons about potential dangers within their store. "Walmart had a duty to use ordinary care to ensure the premises did not present an unreasonably dangerous condition," the petition asserts. It further contends that Walmart's employees did not exercise reasonable care in maintaining the store's safety standards, leading directly to L.C.'s injuries.
Conway is seeking monetary relief of less than $75,000 for damages including medical expenses incurred due to the incident and anticipated future medical costs. Additionally, she demands compensation for lost wages or loss of earning capacity resulting from the injuries sustained by her child. The plaintiff also requests pre-judgment and post-judgment interest on all damages accrued until the date of judgment at the highest legal rate.
The case highlights significant issues regarding premises liability and corporate responsibility towards customer safety. Through this lawsuit, Conway aims to hold Walmart accountable for what she describes as preventable harm caused by negligence on their part.
