A customer has filed a lawsuit against a prominent meat market chain and its associated entities, alleging negligence after sustaining severe injuries from tripping over a pallet left unattended at one of their store locations. Jesus D. Nieto Saldana initiated the complaint on April 9, 2025, in the District Court of Harris County, Texas, naming La Michoacana Meat Market, Inc., along with its management and distribution partners as defendants.
The incident occurred on July 6, 2023, when Saldana visited La Michoacana Meat Market #069 in Baytown, Texas. During his visit, an employee of Faust Distributing Co., Inc., one of the defendants, was delivering products to the store. The delivery worker allegedly left a jack lift with a pallet blocking the entrance to the store. As Saldana exited the premises, he tripped over this obstruction and fell violently, resulting in significant bodily harm. According to the plaintiff's petition, "the occurrence made the basis of this suit... was proximately caused by the negligent conduct of the Defendants."
Saldana's legal action claims that La Michoacana Meat Market and its related entities failed in their duty to maintain safe premises for customers by not ensuring that no dangerous conditions existed that could cause injury. The plaintiff accuses these companies of negligence and gross negligence for failing to inspect their premises adequately and allowing hazardous conditions to develop at their store entrance. The lawsuit further asserts that these failures constitute breaches of duty under Texas law.
In addition to seeking monetary compensation exceeding $1 million for medical expenses incurred due to his injuries, Saldana is also pursuing damages for future medical costs, physical pain and suffering (both past and future), mental anguish, loss of wages and earning capacity, disfigurement, and other related damages. The complaint emphasizes that "the injuries are permanent in nature" and have had a lasting impact on Saldana's health.
