Telecommunications Company Sues Construction Firm Over Alleged Cable Damage

Zayo Group, LLC has taken legal action against Aranda Industries, LLC, accusing the latter of causing significant damage to its telecommunications infrastructure. The complaint was filed by Zayo Group, LLC in the District Court of Harris County, Texas on May 9, 2025. Aranda Industries is alleged to have damaged underground cables belonging to Zayo during an excavation operation.

The case centers around an incident that occurred on or about May 11, 2023. According to the petition filed by Zayo Group, Aranda Industries was conducting excavation work at a site located at or near 1507 Colonial Parkway in Katy, Harris County, Texas. This work allegedly resulted in damage to a telecommunications cable owned by Zayo. The plaintiff claims that this cable was lawfully installed and maintained under agreements with various governmental entities including the State of Texas and Harris County. "Without the knowledge or consent and against the will of Plaintiff Zayo," Aranda's actions led to what Zayo describes as a "disturbance of use or servitude" and inflicted actual damages amounting to at least $27,268.99.

Zayo Group has presented two primary claims for relief: trespass and negligence. In their first claim for trespass, they assert that Aranda Industries acted without permission when they entered onto land where Zayo had rights to install its cables. The second claim accuses Aranda of negligence for failing to take necessary precautions during their excavation activities. Specific allegations include failing to plan adequately to avoid damaging underground utilities and not training employees properly on how to handle such situations.

The plaintiff is seeking several forms of relief from the court. They request actual damages exceeding $27,268.99 along with punitive damages aimed at punishing Aranda Industries for what they describe as grossly negligent behavior exhibiting "a willful and wanton disregard" for Zayo's rights. Additionally, they seek interest on these amounts as permitted by law and compensation for all legal costs incurred due to this action.
