Man says father's wife removed him from will

A Texas City man is suing over claims his father's wife removed him from his father's will.

Brian Pitts filed a lawsuit Oct. 15, 2014, in Galveston County District Court against Laura Louise Pitts, individually and as representative of the estate of Kimsey Edward Pitts, citing conversion.

According to the complaint, the plaintiff's father, Kimsey Pitts, underwent treatment for his cancer in his last 10 years of life, which severely diminished his mental capacity and, during which time his wife, Laura Louise Pitts, coerced him into changing the primary beneficiary in his non-probate accounts, payable on death accounts and will from his son to her. The complaint states Kimsey Pitts lacked contractual and testamentary capacity to make the changes, and Laura Pitts is accused of conversion.

Brian Pitts seeks declaratory judgment that the changes are invalid and that Laura Pitts is to receive no portion due to her fraud and undue influence. He is represented by attorneys Jorge Borunda and Michael Trevino of Radack and Borunda in Houston.
