Alleging it’s Carnival Magic’s fault their six-year old daughter’s finger was slammed in a door, Kirk and Esther Smith have filed a lawsuit against the well-known cruise line.
As next of friends of Karina Smith, the couple filed their suit on Wednesday, March 3 in Galveston County – County Court at Law No. 3.
The Smiths allege that on July 11 Karina, six years old at the time, had her finger slammed in a door while aboard Carnival magic, resulting in permanent injury.
The suit does not state what Karina or her parents were doing at the time, only that Karina was aboard and under the care of Carnival.
The Smiths accuse Carnival of negligently creating a dangerous defect and failing to correct the alleged dangerous condition to provide a safe place for customers.
They allege their daughter is suffering needlessly with anxiety, pain and illness, and are suing for her medical expenses, mental anguish, disfigurement and future loss of earnings.
