Steel worker sues for injuries from electrical fire

A Jefferson County industrial worker brought suit against a steel company on claims of negligence related to a 2013 workplace accident.

Mario de los Santos filed against Gerdau Ameristeel U.S. Inc., of Austin, in Jefferson County District Court on March 3, claiming negligence.

According to the lawsuit, de los Santos was employed by M&I Electric Industries Inc. While working on or about July 15, 2013, at the defendant’s steel mill in Vidor, an electrical fire broke out in equipment belonging to the defendant. The plaintiff suffered bodily injuries.

The complaint maintains that Gerdau Ameristeel U.S. failed to inspect and maintain the work site; and neglected to comply with industry standards, properly insulate cables, warn the plaintiff of dangerous conditions, provide a safe work place, properly train employees and take necessary safety precautions.

The plaintiff pleads a right of recovery under premises liability, according to court documents.

Citing pain and suffering, impairment, loss of earning capacity and disfigurement, he seeks: between $200,000 and $1 million in exemplary and punitive damages; future and back pay; attorney’s fees; expenses and costs. He is represented by attorney Cody Dishon of Provost Umphrey Law Firm of Beaumont.
